My fiance and I went to Affordabale Living Homes and after talking to the sales rep there, we signed up for house and land package. Signed the form that says we cannot change the structure of the building anymore and the prelim document. Paid $2000 as deposit. After a few days, we are not happy anymore with them for various reasons, mainly the reviews and the attitude of the company. I called the sales manager and told him I want to pull out for personal reasons, he asked me what that personal reason is. I told him it IS a personal reason and he pushed further: I need to know that personal reason. He was very rude. I told him my company cannot grant me full time employment anymore. So he asked me for a written proof from my company that I have no full time work which is fine because HR are my friends. Then the sales manager asked me to come in and run through "things" on Tuesday. He asked me if I want them to cancel the land too and I said no because I want to keep the land. I just don't want to build with them anymore.
I spoke to the sales rep today and asked about the deposit. He said I will not get my deposit back because in the documents that we signed, it states that the deposit is non-refundable. Well, he did not give me any document copies until today. When I asked about them, he said it will take 3 weeks to prepare them so now we have nothing for reference like what we signed, what are the rules and stuff like that.
And from the posts that I read from there, someone was told he will get sued by Affordable Living Homes if he went with another builder. And I also read other stories about you guys getting your deposit back. What can I do to get my deposit back and avoid lawsuit? I am very scared. Please help me.
