Some of you may find these things trivial but I can not change the contract without a fee, why is it Aveling continually changes things in my design because they are lazy. Latest issues. 1. Ensuite mirror is now too big - be aware they did the drawings and signed off on the design 2. Toilet wall will be moved to install smaller mirror which leaves toilet not central 3. Bedroom 2 BIR doors are too big and need change 4. Colours chosen at pre-start for cupboards can no longer be made and need changing 5. The cupboard changes will likely need a tile change as well During the call going through all of this I mentioned they had 2 power points on the wrong wall, they had the nerve to tell me it would be a $250 variation fee to change them. F*&!!!!!!!! you Aveling, you change things every week, how about you give a couple of changes to me for free as I am changing things to suit your inability to manage your own suppliers and people. I had asked for a variation two days before (happy to pay the variation fee) but I figured since the plans needed to be put through drafting anyway because of redinks mistake then I would ask if they could refund my variation fee. They did! I felt cheeky asking but I was annoyed I was asked to chnge something so late in the piece. IMO - with the amt of things they have asked you to change you should be able to negotiate the removal of a variation fee for something so minor! Goodluck! Re: My Aveling Build 206Nov 11, 2013 2:03 pm If you have to move something due to a change they are wanting to make then they shouldn't charge you! I'd suggest taking it further. I know when we had issues we discovered that there is only so much CL's are allowed to do and they often run from a script to respond to queries. I know when we wanted to change the kitchen we were told no and when I pushed it they said yes.... Sometimes I think they give the easy answer first to save them work/effort! And btw I don't think any of those are 'small' things! And if you have to change cupboard colours you should be able to change tiles without being charged a variation! I think you'd be within your rights to refuse to accept their variations if they are making changes for anything other than structural, statutory or safety reasons. If the things are changing because "they" have chosen to change it why can't you charge them a variation fee? After all you've got to spend your valuable time checking the new plans and signing them. Well after an afternoon of arguing I have got the change pushed through at no cost. I rang the MBA and Chanber of commerce as I am really not happy with Aveling at the moment. I also went through the contract again, our government/fair trading/anyone who makes money from building has seriously screwed the purchaser. It's fun finding out I have no rights as a purchaser. Did you know if they want to make a change and you don't sign the variation within 5 working days they can do it anyway, the only stipulation is they can't charge you for it. Well at least I am up to date with my rights......well lack of rights anyway. We discovered as well how few rights we have as the purchaser when we first had issues with the build. We've contacted the building commission a few times since and they will say what 'should happen' and then go on to say but if you do that the builder will make your life difficult and there isnt really much you can do, which builders know!
