Browse Forums Building A New House 1 May 12, 2013 8:45 pm Hi all, Our neighbour's house is currently being built next to our vacant block and we have noticed that they have built their carport on our boundary. The encumbrance states that the build has to be 1 metre from the boundary. They also have a red roof when it states no red is allowed in the estate..... Who is at fault, council or the builder? A bricked garage I could cope with with, but how am I meant to put a good neighbour colorbond fence up when the footings are in the way? Any suggestions/advice would be great thanks. They would have signed the contract of sale for the land which would have contained all the stipulations, and they would have had the responsibility to ensure their plans accounted for that? As such the developer should enforce them while the estate is being developed. Once the development is finished the developer loses interest and its really up to those people affected to complain. Generally unless the residents proposals contravene planning regulations the council isn't interested.
