Browse Forums Building A New House 1 May 08, 2013 2:50 pm Hi Does anyone know what you can do or have any experience of what you can do if your adjoining neighbour has received approval from the council for something out of code which we had opposed but the council approved it anyway. The council has told us that they have made a ruling and its final and there is nothing we can do about it but it doesn't seem right to me? I've had a look on the Internet to see if I can find anything but have come up with nothing, so if anyone has any advice it would be helpful. If you're having trouble understanding how they came to approve the development then you can certainly ask them for further clarification on that, as when a 'variation' under the performance criteria of the R-Codes is approved then the City would need to look into the specific implications that development would have on neighbouring sites as well as the locality in general. If you're still dissatisfied with their response then maybe approach your local Councillor for further information. However in my experience (planner with 5+ years experience) it is probably best to just accept the decision and move on, as ultimately there is no mechanism that would enable their decision to be revoked. I know my brother has had a horrible experience with something similar in that the city approved an extension that has a balcony directly overlooking his backyard. I agree with Col88, it seems there is little continuity with decisions coming out of the planning office at Joondalup. Are you building yet??
