Browse Forums Building A New House 1 May 07, 2013 4:36 pm Hi everyone, I am trying to find anyone who has had a similar issue to mine or at least, someone who would know the best way to handle this. I am building with Henley. During the construction stage, the fence at the back of our property (the fence gives to a creek at the back) has fallen down. This fence was standing up all the way up the framing stage. According to them, the fence was old and dilapidated and that's why it fell down on its own. However, the fence looked solid enough to me and was even reinforced. They are now refusing to do anything with the fence. During the pre-handover inspection, the person that showed us the house said that they will deal with the council and prop the fence back up. Now the construction manager is claiming that since the fence did not fall down because of Henley, they will not do anything. I am fighting this because the person who showed up the house at the pre-handover stage has said that this should be propped back up. Has anyone got any advise on how to best handle this? Other than the handover guy saying they will prop it up, do you have any evidence that this is caused by Henley. As Henley said that the fence is in a dilapidated state do you have any photos taken during the framing stage with the fence in the back ground looking alright. If you've got no photos of the fencing prior to Henley taking control of the site then you'll be hard pressed to prove they knocked it over. I replaced my fences after demolition and prior to construction. My builder has already damaged the new fences - and have stated they'll fix them - but I have a million photos to back it up should they try to tell me it was like that when they started.
