Browse Forums Building A New House 1 Apr 11, 2013 8:21 pm I just wonder what you would do if for example at prestart you specified parts of house to be just like the display's and it ends up looking different. One example is our benchtop, we told our prestart person to copy what's at the display home and were told yes and today had a look at the house and it isnt the same. And what's sad is when i mentioned this to the building supervisor he said it wasnt in the draft. The display benchtop is a teardrop type benchtop and ours is just the ordinary one right now. How was i supposed to know that it's called a teardrop when i made it clear to the person to copy it. Now they are saying i cant do anything cos it wasnt in the contract. Even my front feature wall isnt the same as the display's when the same thing was discussed. But again told, it wasnt worded in the contract. It's very disappointing but if you don't have proof of the agreement, i guess it was never discussed? Can anyone tell me if i can do something about it? Thanks everyone Re: Need Help please 2Apr 11, 2013 8:29 pm is it possible that you can change them but at a cost . it may be hard now if the house is nearly complete and by it not being in the contract you may have nothing to fall back on. i would talk to the manager or higher and explain your situation and see if something could be worked out. when we asked for certain items like paint to be the same as the display home . it was checked through the display home spec sheet and then added. sorry cannot be much help but all the best Re: Need Help please 3Apr 11, 2013 8:38 pm Thanks 1rocky... It's very annoying, i was hoping they could change it but i dont have any proof to fall back on Re: Need Help please 4Apr 12, 2013 4:47 am that is the problem as they will deny all day , but still try and talk to a higher authority and see what can be done Re: Need Help please 5Apr 12, 2013 8:06 am If its already built and you have nothing in writing to say otherwise, and you didn't pick up the error in the plans or contract specification, then I doubt you're going to win this one. We did have an issue before signing the contract about something not drawn as per our request and had been priced per our request by the sales rep. To get it changed to what we originally wanted would have cost us via a variation, however the sales rep backed us up and told the office that yes indeed we were correct in what we were saying and that they needed to correct it without further cost to us. But this was before we'd signed the full contract and was picked up when reviewing the plans for sign off. Your only hope is if whoever you spoke to about this is prepared to back you, but unfortunately you've signed off all your documentation with what they've ended up building and whilst you may not have completely understood what you've signed, legally you're committed. You should always make sure you understand everything you're signing. Completed a knock down and rebuild in northern Melbourne. Handover completed 27/09/2013 and now moved in. Thank you @.
