Browse Forums Building A New House 1 Nov 20, 2013 10:45 am Does anyone know, when a fence needs to be installed ontop of a limestone retaining wall so there are added costs of drilling, are these costs split between both neighbours as part of the cost of the fence? We just got a quote that the cost of the fence was split but the cost of drilling is on us. Doesn't seem right when we both share the limestone wall... And we have a block next to ours on the corner which has there rear fence as our right fence. If they wern't there we would only need fencing up until the front of our house (so not for the front 3 metres of the property that is the front yard). Does this mean the cost of the fencing for those 3 metres since they need a full size fence there is on them or do we need to split the cost of that even though we wouldn't have a fence there? The fencing laws don't get that specific, they just say fencing is split and the neighbour only has to pay once they start to develop their block, if it is vacant they don't have to pay, which makes sense. One thing to remember - these people may be your neighbours for many many years. They could even become good friends. Fences are in the top group of things that cause trouble and even court cases. So - my advice - be fair and put yourself in their shoes when trying to come to an agreement. (If they were good friends what would you do ?). If the fence is between your 2 properties you should pay half - depending on what is required. If they want stone ... and you want colorbond - then they should pay the difference. If its your retaining wall - ie you need it - not them - then you should pay for it - and the drilling - which they didn't need. Its a tricky thing dealing with people you don't know. But first build generally gets the "honour" of organising it all. Re: Fencing Questions - WA 3Nov 20, 2013 11:30 am That's the thing, I really don't want to cause any problems, it was more of a curiousity thing, what is common practice. From the perspective of it being our retaining wall, I am not sure it's ours but it is more prominent on our property since they are at the top and with it being only about $140 I would rather pay it than cause any issues. I think the other one, we will organise our fencing around our house, when they want to deal with the part that is more theirs I am happy to pay half but I will leave that to them to organise. Re: Fencing Questions - WA 4Nov 20, 2013 11:31 am We just split our costs in half, there was no discussion about drilling etc. We left the fencing off at the front, partly because next door hasn't started building yet so it may have had to come down and not everyone has the side fence in front of the house. My understanding is it should be split 50/50, if the limestone retaining was done by the developer and not you when building I would have thought this would even more so mean you split the total cost. Re: Fencing Questions - WA 5Nov 20, 2013 11:39 am I agree with you fmac, I thought everything was 50/50, as i would imagine the neighbours would think. Will leave the front part of the fencing off for now, deal with it later! Need to remove glass panel out of concrete without wrecking the glass to get the spa room in, any recommendations on how to do that. Thank you 0 39105 We are at the stage on our build in Kilcoy, Queensland where we need to get our fencing installed but we cant get any contact details for our neighbours to give them… 0 6265 Personally, considering your layout (study/work desks in bedrooms), I don't think you have any other option but to leave NW windows and make them as big as possible e.g.… 7 10589 |
