Browse Forums Building A New House 1 Apr 02, 2013 9:35 pm Hi all, Was scanning the forums looking for an answer thought it was easiest to post it. We have signed a contract and everything was ticking along fine... We put down the 5% etc. When we got to DA approval we've been requested for a hydraulic plan as we need a storm water system... We had 15k in the contract for this... Turns out we don't just need a system that it will also requiring filling to be conducted on the house to allow for it.... To top it off the cost is looking like 40k.... (I'd allowed a little fat for a blow out but now 25k!) the other issue being it will render our side access useless which is why we specifically chose the house design. To top it off simply drawing the plan will be 3500 (on top of the estimated cost...) So without the hydraulic plan DA can not be completed, given the estimated cost of the hydralic I'm reluctant to continue the process until we have sufficient funds.... Where do we stand if we pull out of the contract? Given it was already signed. They have only drawn plans so far and DA has obviously stalled until the hydraulic is done. Do they simply take their costs up to this point? Re: HIA contract - withdrawal post signing? 2Apr 02, 2013 9:46 pm Strictly speaking if you pull out builder will be entitled to sue you for the profit he would have made, but talk to the builder and he may be lenient, try your luck or your will have to wear the cost either way. From my view this is a council requested modification? Surely it's reasonable grounds on the ASIs of the clause You talk about deletions, are they variations or PS and PC adjustments? pleas list them 1 16568 10 12321 Unless there is something in special conditions the builder does not have to give you timeline.
