I entered into a contract to have a house built in my back yard. The builder is at lock up stage and has exceeded the contract date. He is in financial strife and has hit me for more money for underground power supply to existing house inc conduits and trenching, rewiring lighting circuits to bring the existing house to current standards and install RCD switch.
My argument is that the builder would have known that an underground power supply was required had he made reasonable enquiries (visit the site and its obvious its currently above ground) and has entered the contract without making reasonable enquiries. I agree that the builder might not have known that the existing house needed rewiring to get it to current standards by just looking at it but the underground part is obvious.
Has anyone had similar issues in dealing with the part of the clause that covers "reasonable enquiries" in the contract.
I am digging my heels in and he is trying to intimidate me.
ANY advise regarding this is very much appreciated.
