Browse Forums Building A New House 1 Nov 16, 2012 2:16 pm Hi guys, We're building with Porter Davis and had our Tender appointment yesterday. We went through site costs and where we wanted the house to be sited on the block of land. We discovered we have to apply for a dispensation from our city council due to not meeting certain requirements. The house next to us has approximately a 4700mm front setback so apparently we have to follow that as well just so it's aligned to next door. Our easement is 2m and at the back of the block, issue is that our eaves are slightly hanging over this easement by just 50mm! - Eaves are 450mm and there's approximately 2400mm space at the back. What are my best options here? It would be greatly appreciated to get a second opinion. (Must I advise you, chopping off the eaves at the back is a no go for a dad haha) - Apply for dispensation for having the eaves hang over the easement by 50mm? What are chances of the council saying yes to this? - Apply for a dispensation to bring my house forward to have a 4650mm front setback instead and then the eaves won't hang over the easement? (I've looked at the two houses next to me on Google maps and one of them looks like it slightly has a smaller setback than the neighbour next to me. Although it may be inaccurate as it is just as image, I guess I should visit the site and have a look at the houses next to mine. What does everyone think? In the unlikely event that they need to access the pipe for any reason, there cannot be anything obstructing the access. I would also check - with our last house we couldn't build right up to the easement - we had to have a 1500mm setback from that as well. I highly doubt that council will let you overhang the easement, and as stated above I find it strange that they would allow you to build right up to it (although this is dependent on the type of easement) Best chance would be to go for a relaxation for the front setback - this minimum tends to be for the provision of services and aesthetic reasons.
