There always lots of discussion about fences. Strange isn't it? How something so straight forward can get so complex and emotional!
Anyway, here is MY fence problem. I'm building in a new area. My neighbour has just finished and moved in. My house is half done. My new neighbour has just bailed me up about the fence. He needs to build a small (30-60cm) retaining wall for about half the length of his block and his plan was to put he new fence on top of that (ie a good solid concrete/brick foundation for the fence). All sounds like a good idea to me for the long life of the fence.
His plan is to build a small brick retaining wall, one brick on my side, 2nd brick on his side, fence bolted to the middle (ie the boundary). I really had no problem with this as the fence was still on the boundary, and as far as the wall was concerned, it was at/below ground level on my side, so I'm not losing anything, even though I suppose technically his retaining wall will half be on my property.
My alarm bells started ringing when he bailed me up again he other day and said he was going to give me "a piece of paper" he wrote to sign re the fence. I haven't seen it yet but I'm thinking this isn't going to be a good idea. Thoughts anyone? Do I tell him to build his wall on his own land even though the thought of a good foundation for the fence is attractive? Where I'm living now (a rental house) has the same issue, but with a significant wood wall under the zincalum fence. Honestly, if he just did it without me "signing" anything, i wouldn't have an issue!
