Browse Forums Building A New House 1 Nov 08, 2012 2:02 pm Hi All, I had signed a building contract with a builder in last week of July. The format was same as HIA format. Nothing was done until first week of October except drawing. The trouble started after signing the contract. The consultant hardly had time for us, No update from him, incorrect drawings and so on.. After constantly chasing up with him, we finally decided to give up and cancel the contract. We had deposited $1,500 and cancelled the contract before the final drawing was accepted by us. After a week we got a registered letter from the builder demanding $20,000 from us citing loss of profit for the work which they had not started even!!!. Can someone please help if his demand is legitimate or should I go ahead and lodge a complain in consumer & business affairs? Thanks, Re: Cancelling a building contract after cooling off period 2Nov 08, 2012 2:14 pm I would be surprised if what you signed is a full contract as its normal to pay 5% on signing the contract. The only thing to do is read the contract preferably with a lawyer. The Harder You Try - the Luckier You Get ! Re: Cancelling a building contract after cooling off period 5Nov 08, 2012 2:54 pm I dont know if this matters, but maybe one other thing to look at is if a contract is deemed to be finalised when you signed the drawings as well.. I would have thought that a contract needs drawings included. Re: Cancelling a building contract after cooling off period 7Nov 08, 2012 3:10 pm Well in that case my point doesnt apply but like bashworth said, you need to seek the advice of a lawyer in this instance.
