Developer's rep said it's due for pre hand over to Western Power for inspection on 04th Nov. Once that's done and all good then power will be live. Regards J19C21 Hi J19C21 No our settlement actually went through ok, just took a while. (from Oct 13-July14) The main problem now is being charged for generator hire. Now they are trying to find out what is happening. I emailed Consumer Protection and they recommended to seek legal advice which is what I already know. I was some what disappointed with the response because it seemed quite standard. I have copied the response below for your reference. The Department recommends that you seek independent legal advice on this matter. Re: Buiding in Riva Piara Waters! 155Dec 08, 2014 3:02 pm The ATO are unable to do anything about the garnish notices - the only way forward is to issue a default notice to the seller and begin the legal process in order to get settlement.
If you have not already done so, I would also suggest that you ask your settlement agent/ lawyer to place a caveat on the land, as you may be at risk of losing it. Re: Buiding in Riva Piara Waters! 156Dec 11, 2014 12:01 pm Hi, My partner and I are in the same situation as all of you. Waiting for settlement since July when the titles issued. We have just lodged a caveat on Monday to protect our land from being sold by the developer. Our solicitor has written to the seller's solicitor demanding settlement which has just expired and nothing has happened. We are now contacting the solicitor to find out what to do next. It's very frustrating being left in the dark as you will all agree and not knowing how long it will take for settlement to occur. I think we need to form a group and take them to court to get the issue sorted and get our blocks settled so we can all start building. Please private message me if you are interested. Peopke living in their homes more than a year and still no landscaping done . But apparently new landscaping team are coming in and starting to do the landscaping . Phew, finally we are getting there after such a long wait.. The build process so far has been stress-free except delays in titles.
