Get advice from a lawyer but you will find that the termination notices are actually invalid under the contract - the clause that is cited on the notice refers to subdivision approvals and does not give the seller powers to terminate as a result of the garnishee notices issued by the ATO. It should also be a red flag to you that the notices are signed by the director of the company, and NOT a lawyer. These termination notices are totally invalid. Don't walk away and give up if you receive one of these notices, get advice from a lawyer first! Hi Vanfitz, I am in the similar situation to you. My lawyer didn't put Caviate, so they sold it without contract termination. lawyer said we can claim damages and he is working on the case. |
