Browse Forums Building A New House 1 Oct 16, 2012 11:32 am Hello - our builder is currently digging the trenches on our block and it turn out they are much deeper than predicted, they have sent us an email saying that as a result there is a variation to the contract.....will we have to pay for the cost of the deeper trenches? I presumed we signed a contract to protect us against these unexpected issues? Can the builder just 'change the price' after the fact? Any help would be much appreciated!! If it priced similar to a Waffle Pod slab Pier allowance there should be something that indicates the charge. This stuff is usually pretty clear and they will make specific effort to point this stuff out when you go in to sign the Building Contract Re: Help - variation to contract by builder 7Oct 16, 2012 3:06 pm I don’t know why footing depth/slab design would have to change after the contract was signed. If the soil test and engineering design was signed off after the contract was signed, I’d understand but getting on site and deciding they need to be dug deeper now is a bit odd. Question the reason as to why – if it’s to suit the design of the slab and this was changed after contract signing, tough luck for them.
