Really, It comes down to how many changes you make to the standard plan and specification and how many times you change your mind (which is fine to do at this stage). From that point on it's been one disaster after another - though it was the same in the early stage, a complete inability to plan ahead. We signed the pre-contract and waiting for building contract. can we go with builder 2 if we find that builder 1 is not good and if we can, do we have to pay builder 1 any money other than what we paid him at the pre-contract stage? Both builder 1 and 2 were paid for pre-contract work but as the building contract had not been signed there was no funds outstanding. Builder 2 quoted some of the HIA contracts clauses (about time constraints and penalties) in the pre-contract and was using this to try and push us into signing once we were close to the 150 day time limit from deposit – just a pressure tactic they tried to use, ignore any of this type of rubbish.
