We will start building our house in south-west Sydney in the next 2-3 weeks.
As soon we thought that the things were getting on the rails, we faced another problem.
The neighbouring 4 vacant lots were bought by a builder, who have built houses on them and I think will be sold as home & land packages.
During their built they were using our vacant block for their vehicles access for deliveries and services, temp storage, meal breaks area for the workers in the winter sun, etc, basically whenever they felt convenient, which they never had our permission. But that’s not the problem.
After completion of the house, previous weekend from the last, we noticed that they had put a large heap of around 2-3 tons of building waste on part of our land. We thought they will remove it. But to our greater surprise and shock we found last weekend that the heap of waste has been spread over the natural land surface of the block. Now the land has exposed sharp metal pieces, nails, broken glass, rocks, bricks, cement lumps, used packaging, plastic sheets, etc. In the process they have even removed a small tree from the community land to make access to a large tip bin, which I have already reported to the developers.
I have so far requested the builders to clean up the mess.
Hope they will do the right thing.
From their actions they appear to be arrogant cowboys, who may or may not cooperate.
In case they refuse to help, I have to look into reporting the matter to a relevant authority. (????)
To my understanding they are accountable of;
Trespassing,
Using the land without owner’s permission,
Intentional property damage,
Inappropriate disposal of contaminated building waste,
Breaking some of the building industry code, and
Removing a community tree.
Please help with your thought on this. I am nervous that we may have a battle in hand, that could also delay our house building project.
Not happy with this completely unexpected problem.
