Browse Forums Building A New House 1 Sep 15, 2012 12:30 am We have just signed our contract to build in Townsville Bushland Beach and as we are very close to the ocean I asked our builder if the warranty would change for our roof (Bluescope Colourbond) builder informed us the roof is not covered by warranty at all as we are too close to the ocean... Not sure what to do here people I feel really uneasy about building a new home without warranty on the roof? Is it because they don't want you using Colourbond? Is there an option apart from Bluescope which is warranted, or do Bluescope offer a tougher product for that purpose or something? I could be being over-cynical, but I believe a builder might use a lack of warranty on one part as an excuse for being less careful about related parts. "My roof leaks & it's only a year old!" --> "Oh that's because the Colourbond isn't under warranty." Re: New home New roof NO WARRANTY 3Sep 15, 2012 8:54 am I would ask bluescope, if there is a manufacturer warranty that does apply then I don't see how the builder can do any less than provide a warranty on his installation work! You could also ask the insurance company directly if it's covered under insurance, again I can't see why not! Insurance won't cover things like it's leaking but should cover things like it blew away or a tree smashed through it! (Always read the pds and policy!) A quick look colorbond is not covered by warranty under 5km from salt water, but colorbond ultra steel does have a 10 year warranty when installed in harsh marine environments like less than 100m from breaking surf! 2 Re: New home New roof NO WARRANTY 4Sep 15, 2012 4:03 pm I wouldn't be using colorbond close to the ocean for obvious reasons, especially when not under warranty. That is the art and skill of the building design. If the design is builder's responsibility as in design and construct job then the builder is responsible for the selection and the guarantees. It's no good to design and quote build job and once the contract is signed to say "we can't guarantee it". Just make sure that materials are not substituted with cheap import that will not last. Apparently a rep from Bluescope confirmed with the builders roofing supplier and advised No warranty available for the product due to our proximity to the ocean, which is approx 60 meters from the rear of house to sand and high tide water line. no breaking waves or surf it is quite calm. Ed we are given a 6 yr structural warranty with this build, are you suggesting this builders warranty would cover the roofing product during this time. Tel. 1800 326 326 Re: New home New roof NO WARRANTY 9Sep 16, 2012 7:32 am Your new dwelling is subject to two types of warranties (in Vic.) 1 Structural warranty under Home Owners Warranty 2 Implied Statutory Warranties under DCBA 1995 (I assume Qld. has something similar), which includes warranty of fitness for purpose. s8 (f) DCBA1995 If the contract states the particular purpose for which the work is required, or the result which the building owner wishes the work to achieve, so as to show that the building owner relies on the builder's skill and judgment, the builder warrants that the work and material used in carrying out the work will be reasonably fit for that purpose or will be of such a nature and quality that they might reasonably be expected to achieve that result. This means that materials selected by the building designer must be fit for the purpose for which they are used, given the conditions they are required to perform in ( providing you are relying on builder's design). So, if builder has chosen roofing material for use in conditions which are not recommended by the manufacturer and the material fails prematurely , you will have a valid warranty claim. If you have had your own design separately from the builder then obviously you cannot blame the builder. Neither of the statutory warranties can be excluded by contract If you have builder's design, warranty stands irrespective of what the builder says even if you sign otherwise.
