We sent off all the paperwork this week showing why they should still give us the money, but the bank won't pay any further money to the builder until it's sorted out. Good luck with that - Unfortunately for you, the QBBG was a Labor government initative. In my role, I work closely with a number of people in the OSR who have specified that since the LNP gained power, the Commissioner's discretion has tightened significantly so that the number of claims paid has been significantly reduced to save $$$$ If they can get you on a technicality they will! I guess your main issue is that the guidelines of the QBBG state that "building work must commence within 26 weeks of the transaction commencement day" which would be when you signed the contract on 17th April (making 26 weeks the 17th October?) "If construction does not commence within 26 weeks, or is not completed within the above mentioned time limits you may apply to the Commissioner for an extension if you consider the delays were outside your control (for example, inclement weather, delays by approving authority, availability of certifiers etc.)" Hopefully you were able to supply significant evidence showing that there were circumstances outside your control and you get someone in the OSR who is in a good mood (not that there are many left - a whole heap of them got made redundant!). So we sent off all the evidence etc to OSR on Monday, I rang them on Wednesday and they said it can take a few months for the decision to be overturned, so we ended up having to put $10,000 towards the build so the bank would start paying again. Hopefully we get it back in a few months, we submitted all our evidence including a letter from Westpac admitting fault in taking so long to settle the land. If we don't get it, I'll be taking it further with Westpac because of all of their stuffups, that's for sure! Anyway - the builder has been really good. They didn't stop work or anything (obviously they have now). We will be at lockup hopefully around 15 Jan, as the garage door goes on around then. Here are some photos for now! The builder is now up-to-date with payments, so just waiting on getting the $10,000 back now! Got a few nifty things for the house for Christmas - my Mum bought me this gorgeous little touch lamp that has a New York (actually I think it's just a normal city skyline, but I'm imagining it as NYC!) skyline on it, and when the light is on, all the little lights come on in the buildings! So cute! Bought hubby this new grill and roast pan by Baccarat - I'm not sure how it works (he's the chef, literally) but it looks pretty cool. Also got a 3d Blu-ray player, so don't have to buy one of those for the new place. My present - a gorgeous new diamond ring! I keep telling everyone, now that we're married and I have my wedding and engagement rings, I'm just trying to balance out both hands haha. Also got 5 laps in a V8 race car, can't wait for that! I have some pretty specific ideas in mind so I've already ruled out a few stores from what I've seen online. I really just want to go and see how comfy the ones are that I've seen. Also have to find a bookcase and an entertainment unit...but those two aren't as vital as a lounge. Most places seem to need around 10 weeks for delivery so we will have to order in the next few weeks. They are from Far Pavilions. I'm starting to forget what they look like! Haha. So we decided on a couch for the media room today. I went to four different stores, and no-one had exactly what I wanted. That being: Grey, white/ivory or black in colour Preferably fabric as our other lounge is leather At least two recliners, preferably four Something with a drink area preferable Comfortable! The one I found ticks nearly all the boxes, apart from the drink area. Everything seems to be brown in colour so it really narrowed down our choices. This is a picture of them when we first bought them in 2009 (excuse the feral little dining room, it was a tiny little unit we were living in at the time).
