Does our house really have to be 8.5m from the kerb? I feel like borrowing a trundle wheel and measuring our neighbour's setback. I have paced it and it paces at about 5m from kerb. With your example if the set back is 5m and the council land to the road is 3.5m and the drive is 9.5m then it may be that the house is set 1m back. This could be the case if the other side is closer than 5m as it is meant to be the average. (at least I thought). I do not believe that the council land is included in the setback. Would be interested to know what you determine. Which state are you in. If WA I have the R-codes.... but me thinks you are not in WA.
