Re: PD --> Land Delay Marriott waters = +$6,000 variation 25Mar 31, 2008 10:48 am I don't think land settlement should be as late as May.......you should be ok.........
Saying that though.........once titles are released, you do have 14 days to settle on your land........so titles should be released mid April (so probably in the second week of April)........then you have your 14 days to settle, so as long as that gets done before May you should be ok.......so make sure you have everything else in order so that you can settle early!!!! That means get onto your finance provider, your solicitor, everything so there is no delays in settling....then you won't have to pay the extra!!!! That is what we are trying to do now!!!!! Expected now at end of June instead of end April. Looks like I'm going to have same problem with PD. Anybody else there? Anyway why $6000 and not the actual price difference? And the actual price difference is not easy to work out because of different promotion packages. So, the bottom line, is there any ground for legally disputing the extra charge? looking to build Francis 29 with PD Re: PD --> Land Delay Marriott waters = +$6,000 variation 28Mar 31, 2008 5:12 pm More on the subject.
When I asked this question on my contract appointment with PD, the business manager (not the rep') promised me, 'we will not look at the watch to charge you extra'. So they said they would wait a while. I can't complain so far, they've been reasonably good. We'll see if they keep the promises. I hope PD staff is reading it. Here is your chance to proof your professional stand. looking to build Francis 29 with PD Re: PD --> Land Delay Marriott waters = +$6,000 variation 29Mar 31, 2008 7:18 pm [quote="Cookiemonster"]Our experience with Clarendon has been at the other end of the scale..
Clarendon extended our tender period three times. Mark, i belive you are definitely a lot wiser about the building process and have played your cards well and had negotiated the extended contract. We had no idea that it was possible that the contract would expire and the price could be increased !!! obviously next time I have the benefit of hindsight. Clarendon has been reasonable otherwise but is quite slow when it comes to processing paperwork except for cost variations! For example I asked my CSO for a price to delete a wardrobe about 5 days ago and have not heard back till date... I dont mean to be too critical but they do move super fast when it suits them.. The other point is I know at least another very active user from this forum who have decided to move away from Clarendon after they got the DA and the price variations had a impact on this decision! they were similar to us and did not negotiate the tender expiry period! So far they said they are on schedule to meet the July title
PD used to be my first preference, but this additional cost (if land title delay) did put me off... i think PD has to re-think about this 'cost' again because it does put people away Re: PD --> Land Delay Marriott waters = +$6,000 variation 31Apr 03, 2008 8:23 pm berniebgf Have got an update from Marriott waters..... Stage 2 may push out to end of April....the way things are looking we may be stung for another rise in May! I am seeking legal advice, will keep you posted. Bernie Hi Bernie Any updates on the legal advice ? We also just got informed that our land title will be delayed by 2 months, guess we will be in the same situation as you with PD. Cheers Re: PD --> Land Delay Marriott waters = +$6,000 variation 33Apr 03, 2008 9:04 pm JoBen we have had no updates on our land either Hys ( love your name! ) where are you building?? We are building in western suburb of Melbourne. Will have to talk to PD tomorrow about this land settlement delay. Thinking of worse case scenario, we might ask them what is the cost till date if we pull out of the contract. Any one done that before ? Thank you Re: PD --> Land Delay Marriott waters = +$6,000 variation 35Apr 03, 2008 9:21 pm JoBen i think our csr said it was 25% of the total contract cost, we are building with PD too. 25% ?? That is too high considering that they have yet to start work. Cheers Re: PD --> Land Delay Marriott waters = +$6,000 variation 36Apr 03, 2008 9:55 pm possibly, I think that's what she said- but it may have been if we pull out once building started- we'd been there for 4 hours by this stage ( we waited for our pcv to come back in writing and our csr came down and did them on the spot)- sorry if i gave you a heart attack.
ahhhh-check tomorrow and post!! Re: PD --> Land Delay Marriott waters = +$6,000 variation 37Apr 04, 2008 7:50 pm Hi all,
I did get some legal advice....via phone, and dicovered that it would cost me $350.00 per hour to get to know my Soliciter. Screw you hippy! Anyway, I did some research and found another channel to go through "Consumer Affairs Victoria". Before moving forward with this drastic action, I touched base with PD again and explained our specific circumstance and concerns in detail. After a discussion with the right person at PD, a fair agreement was met. I think it would be unfair on PD to discuss my specific circumstances and outcome as everyone's is different, however I can share some wisdom. 1. Talk to your PD contact and explain your exact situation and concerns. 2. Keep it calm and professional, no point in buring bridges. 3. Legal advice (from what I have investigated) is a waste of time. If I had my time again I would look into my land contract closer and make sure I have completion dates and penalties. Homeone is a great resource for people building, but sometimes I think it drum's up a "them and us" type attitude (my opinion....maybe I was looking for it) as this is a great site for "venting". Anyway, I'm now going to calm down a bit more and when building starts I think I will try and take advice off "Maxie's" rep: Quote "he told me it was best not to visit the site too often and just trust them to get it right " (Thats my post for the month!)
