Browse Forums Building A New House 1 Aug 13, 2012 6:45 pm Hello, I am just wondering what our rights are in these circumstances: We went to look at the house on Sunday and found around six trades plastering the walls....smoking and hawking up loogies and spitting on our cement floors. Right in front of us. We were shocked, now angry, etc. is smoking allowed in the house? As for the spitting, it's foul and unhygienic but I feel like its a lost cause. What are your opinions or advice? I have emailed the builder and awaiting their reply. Seriously though, it is appalling and absolutely disgusting and I would give the tradies a firm personal warning first and if they dont comply, then Id go over there heads to the boss. I don't think those trades will be there long as they have diff trades for frames, bricks, walls etc. the tradies we saw last weekend were all Chinese and when we said hi, they didn't say anything. So I'm not sure if telling them off would have done any good! Unfortunately there's nothing I or you can do about it. Slagging on the floor is not pleasent but remember its still a work site. Even if worksafe dont turn up the builder will freak and jump on them as once he is on their radar it can become a pain. I really dont care what my builder thinks of me for doing so either. Spitting on the floor just makes me sick. Smoking, i have had 2 goes at the tilers already for smoking in the house but it didnt do much unfortunately. They got quite defensive the second time but i knew my builder was happy for me to have a shot at them so i did. Its been plastered and painted and thankfully i cant smell anything as if i could smell something at handover i would be demanding it was dealt with and sorted out accordingly. Long as clean and no evidence after they leave I am fine with it, but I prefer they didn't. I saw someone's toilet the other day that was filty and full of butts and stained - that is not on. Re: Tradies Smoking and spitting in our house 15Aug 15, 2012 2:19 pm I have been on site in homes nearing completion and seen trades smoking inside, which as an ex smoker drives me nuts, even when I did smoke it was never in a client's house!! I am fairly sure that smoking on site would break about 2 laws, one oh&s and the other anti smoking laws, and reasons you can't smoke at a night club any more (at least in Victoria!) As far as I know if it has a roof then you can't smoke! I saw several balconies on commercial sites affix no smoking signs and remove ash trays when those laws came in!
