Does anyone know if a builder can charge for any increases due to the carbon tax if you have already signed a fixed priced HIA contract?
I have read ours and it says 6 (c)
"If further costs are actually imposed on or incurred by the builder as a direct consequence of a written law of the state of WA or the Commonwealth of Australia or on account of an increase in any tax, duty or other charge imposed under any such law after the date of this contract then the builder shall be entitled to increase the contract price to reflect further costs"
As the CT is a "New" tax and not an "increase" will it be passed on do you think? When we built previously and the GST was introduced after signing contract we did not have an increase in costs...
What are you opinions on this one?
