I asked solicitor to look through it and he pointed several things/clauses which are unfair/unclear and so on. The contract itself is HIA but the issues with special condition which are definitely one sided in favour of builder. When the Wisdom Homes got the letter from my solicitor, they replied that they never change anything in contract , they said that I should of know it and that they simply dont have a solicitor to proceed with these changes, but they can hire one at my cost . It was so surprising and unexpected, that such a big company, I guess 3rd in NSW, doesnt have solicitors. At the moment, I am kinda in doubt what to do and is that kind of response from builder normal? Thanks for your responses! I was told is should of been mentioned in advance to me, but of course sales staff dont mention such surprises when you choosing among many builders. My real estate agent, who is my friend, told me that this is not typical for builder not to change anything, but that builders, usually, very hard with changing anything, as they know that you spent already many months with them, paid deposit and for plans, some 3-4 k and unlikely to switch to another company at this stage. I just interested, if anyone else had similar issue with builders. I will post here later on about progress.
