Browse Forums Building A New House 1 May 11, 2012 10:14 pm We've been kicking ourselves due to what we thought was a screw-up on the part of a builder who did some designs which we don't think we're going to go with on the basis of cost ... the end-result was a fairly large house for our block of land, and we've been running 'round looking at display homes with a particular size of house in our minds. Doing some calculations, however, we were a bit shocked to find that our favourite design just wasn't going to happen due to floorspace ratio issues. What the builder seems to have done is said that our block is a size which allows 330sqm under complying development; now NSW complying development rules say you have to count all garage space etc in this. We live in Ryde council, and they have floorspace ratio rules which say 50% is allowable, but they also allow 36sqm for a garage - on our block that'd be 291+36 = 325sqm total under the council rules. Now the total including garage for the designed house was something like 365sqm. The builder deducted 36sqm for garage allowance, that's 329sqm which was therefore deemed to be a complying development. That's not correct, is it? You can't calculate floorspace like that for complying development, by deducting a council allowed garage amount, can you? I very much hope I'm wrong in that statement, you can deduct the council's allowance for garage space, and our favourite design comes back onto the table ... From my understanding (as I looked into both Council DA and Complying Dev for our place), CDC FSR includes the garage, whereas Council DA excludes. So your builder deducting garage space for CDC does indeed sound incorrect. CDC is only a recent thing, so some builders may be less familiar with the rules. We went with Council DA in the end anyway (less FSR allowance, but parts of our house such as deck wouldn't have complied with CDC, plus we are in a Scenic Protection Zone so CDC wasn't an option when we applied). I was heavily emotionally invested in the Edge, but I'd miscalculated the length of our block & the narrow/useless alfresco we'd have to settle for ... we've more recently decided upon a Chifley design of some description but there's going to be some back-and-forth before we know which combo of room sizes will fit on our block along with a large man-cave (ie. they offer it in 27sq, 32sq, 37sq and 42sq variants ... ours will probably be some combination of the 32 & 37).
