If the total height is within 8.5m, will it still qualify for complying development. Technically, we plan to enclose the space at some later stage to make it a Rumpus Room. We would just go through a normal DA for this. Of course that's not the be-all & end-all, you probably need to talk to a builder with experienc ein your area too (from rumour & innuendo, apparently some councils don't allow CD because they want to retain their own little band-of-numpties power-base - dunno how true that is). I'm taking big guesses at a few things here, but I'm guessing Warringah would be one of the "fussy" ones if there are indeed "fussy" ones. In my experience ( 80% of my clientele is in Warringah shire ) once people start going up to 8.5max roof height these other aspects of the DCP become affected too. Knowing what Forestville is like there can be some sloping sites there as well which affect DA's. We live at the end of a cul-de-sac, and have a trapezium shaped block. We are looking at CD because the side setback (building envelope) was an issue with Warringah council. We got knocked back at our pre-DA meeting. I didn't see the anything in the SEPP code on ceiling height. Do we have to comply with the SEPP and the Warringah code, or just the SEPP? Some rules can be ahem stretched though... To be honest I haven't looked at the SEPP for a while as 100% of the jobs I do go into the council as DA's. Stewie Re: Three Storey complying Development in NSW 7May 05, 2012 4:52 pm The side envelope for SEPP complying developement rises 1 in 4 from 4 metres at the side boundry, while Warringah rises 1 in 1. The front setback is also 4.5m for SEPP, while Warringah is 6.5m. This is the reason why we want to use SEPP complying development, rather than go through council. Or have i got it wrong? It is 4m straight up at the boundary ( 5m in some older parts of Freshwater ) then 45º sloping inwards. Have you gone to the Warringah Council website and downloaded the locality statement for your area ? Probably C1 unless you are in one of the little pockets which are classified as something else like C6 That explains a few things like this too.
