Browse Forums Building A New House 1 Apr 13, 2012 12:10 am We are on a corner cottage block and the developer has just started building what they call a "standard brick peir wall" We weren't consulted on the design or anything, but when we went to our block today we realised they've built it completely inside our boundaries and the footings are HUGE. I really don't like it, and we are going to ring them tomorrow and see what they say about it. While it may not appear a lot to some people when you are a cottage block this equates to about ~5% of our land. We don't have a covenant on our title or anything, so shouldn't we get a say if they decide to construct something like this? I'm half hoping its just sloppy trade work and that the footings are oversized. I'd be half tempted when we move in to knock it over and just put standard colorbond up. For reference that retaining wall is 90% inside our boundary. The Councils fencing guidelines say that the lot could have a caveat or be subject to detailed area plans dictating fence type. Ours doesn't have either, nor does it have an outstanding work order saying the lot isn't up to code. When I first bought the lot I asked the council and they said the developer was compelled to build a brick wall adjacent to the lot. Surely there is some sort of estate-council-building regulations that relate to walls/fences and minimum distance from the house. If this has not been approved for your initial building approval papers I would imagine that it would effect the minimum sunlight-window building requirements/regulations.
