Browse Forums Building A New House 1 Mar 21, 2012 1:40 pm Hey fellow forumers I have a little issue. We have our final inspection next Thursday and yes we did sign off on plans, but we had no dimensions of the closest point from the master bedroom to the boundary. They had to put a retainer wall in. Long story short...we only have 900mm between the house and the fence (at the shortest point) should this have been passed through council? are there any minimums? I called our developer to see if we could buy out a portion of the block next door(as it isnt sold) and they suggest to sell our house as is and to reconsider a suitable block (whatever ) how are we supposed to excavate our back yard?? this block has been an omen from day one!!!!! Re: Are there any regulations on a minimum side access 2Mar 21, 2012 2:08 pm Hi Mak_, there should be council or state restrictions on setback from boundary. Our min. side setback is 900mm for ground floor (and 1500mm for first floor). So it sounds they could be within the legal requirements. Re: Are there any regulations on a minimum side access 3Mar 21, 2012 2:35 pm setback aren't to fences, they are to boundaries, which sadly do not always line up. But 900mm is certainly acceptable under certain conditions in WA. Can you clarify were your build is ? Re: Are there any regulations on a minimum side access 4Mar 21, 2012 3:17 pm our boundary is 1150mm but the retainer is 900mm off the house so we have 250mm from the retainer to the boundary. Would have been great if they put it at least on the boundary like the rest of the estate. you should see our blind side!!! 1150mm to boundary and retainer wall is again 250mm off >.< Like ⋅ Add a comment ⋅ Pin to Ideaboard ⋅ We are in Melbourne Nth Suburbs Thank you! Re: Are there any regulations on a minimum side access 5Mar 21, 2012 3:29 pm 900 is the minimum in most area's i would suggest getting any rear yard stuff done before you get neighbours. One of the reasons i got a block with 18mtr frontage Re: Are there any regulations on a minimum side access 6Mar 21, 2012 3:55 pm our block is a very very odd shape...it's 11.5mt at the front and goes out to 29mtrs at the back...i wish we could have afforded an 18mtr frontage block on the size we have ($60,000 more)...we knew we would have some sort of side access issue...but not to the point of struggling to get a wheelbarrow through. We have most neighbours already up except where the retainer is...we are just going to have to use it!!
