I built a new custom designed home with private builder in metro area in Victoria state.
I am new to this site, need an help/advise on my disputes with builder for my new home.
I would say my issue is typical, my builder made me to move in before fully completion of my house, builder advised first move in and pay the final payment after completion of work. This is my first home I trusted builder and moved in, when I asked about occupancy certificate (OC) he said he got one and he will give at the time of settlement. I called my builder and emailed him so many times to fix all out standing items and give me the OC but builder never responded to my emails or calls. This is going for more than 7 months and I compliant to building commission (BACV); in the process, they advised to contact my building surveyors to find out actually my home got OC or not, I did and I found out they never done final inspection to issue OC. BACV organised inspection and they followed up with the builder to fix and provide OC but he didn't responded to them as well. Final option for me is VCAT, i think it is very expensive process if I go thru lawyer however i lost trust that no body can help me to solve my issue because builder is more shifty not respond to any one.
Now my situation is building surveyor issued the building order to evacuate the house in 30days because i do not have OC. which is frustrating me because of builder I have to suffer.
I need quick advise how I can get the OC immediately and get builder to fix these issues.
