Browse Forums Building A New House 1 Feb 25, 2012 11:12 am Hi guys, My partner and I are currently building our new home in a southern suburb of Perth. We have recently realised our house does look a little smaller than our neighbours even thought their blocks are the same sizes/shapes as ours and they started building around the same time as ours. We checked our contract and found that Allowed Coverage in Site Zoning is 55% even though the drawing they used to quote us (before the contract) states it's 50%. Before signing on the sketch (so they could make up contract after this) we asked if we could make the building size bigger and they told and pointed to us as per the sketch that the allowed coverage was 50% and we would't be allowed to. We know we should have checked the final drawing carefully but felt like we got ripped off with this. We have contacted the building commission and they said they wouldn't be able to help us as the contract was signed though we could take some legal actions against this. They could't give us any legal advice though as they are not allowed to. Is there anyone who had a similar experience or can anyone share some knowledge with us? I would say that your sales rep guessed that it is an R20 block and there for is 50% open space. It was put on the plans and the guess became fact. If you call your local council and speak to a planner you can find out the zoning. This zoning will determine your allowable site cover. Be sure to find out if the block is part of a DAP (Detailed Area Plan) as these can vary the site allowance beyond the normal Residential Design Codes R-Coding. If it is in fact 55% site cover take these to your idiot sales rep and tell him he is wrong. It is not ground for getting out of the contract, but you should still be able to get the house size increased because you where advised incorrectly. Keep in mind though that an extra 5% of house is going to cost you and extra 5% in price. If they still wont budge, speak to their General Manager ... sales are tight and they should value your contract It looks like Blacktown council allows up to a 6.0m wide driveway so just ask your builder to change the plans.
