The Supreme Court of Appeal today dismissed Metricon’s appeal against the VCAT ruling. The Softleys’ three-bedroom house suffered major structural faults due to “slab heave” — movement in the footing and foundations following the use of a waffle slab during the construction. " Does anyone know if ebh uses waffle slab or raft slab (better version I assume?) someth that we should be concern about? T Our Eden Brae house has a waffle pod slab. For some good information on soil heave and waffle pod slabs: http://anewhouse.com.au/2014/08/soil-he ... -the-slab/ http://anewhouse.com.au/2012/09/waffle-pod-raft-slab/ I recall that at settlement we received an engineer's report on the slab performed before they started to build on the slab. This gave us good peace of mind that it was properly constructed. Deposit paid 3/9/14. Tender signed 3/10/14. My neighbour is intending to put a A/C unit on the side of the property which is too close ( less than 1.8 m). It Will cause lot of noise and generate heat and is too close to my kids bedrooms. Can I approach council to get it relocated? Thanks Vk Re: Who else is building with Eden Brae? 13528Apr 09, 2016 6:03 pm venniechada Hi guys, I need an advice whether your neighbour can put a A/C unit close to the boundary wall. Can I approach council to get it relocated? Thanks Vk Sorry to hear that Vennie. Here is a link to the Camden Council Environmental Noise Policy - see page 42 for domestic air conditioners. The short story is that a residential air conditioner can be installed without development approval if it meets the criteria for an exempt development. The key criteria for an exempt development is that the air conditioner is located at least 3 metres from any property boundary and behind the building line to any street frontage. It sounds like your neighbour's unit will not satisfy the exempt development criteria and therefore they will need to apply for a DA. You would then get the opportunity to have your say about the issues that concern you. As always, it is better to have a chat with your neighbour as soon as possible. They may not be aware of the legal requirements. http://www.camden.nsw.gov.au/assets/pdf ... dments.pdf Deposit paid 3/9/14. Tender signed 3/10/14. I will have a chat with him to see if he accepts to move it as it is in construction phase and he can change it . Re: Who else is building with Eden Brae? 13530Apr 10, 2016 1:35 pm Thanks Marko, Most of people are not aware of the law. I am posting the info from the Pdf you shared to wider audience. Air conditioners (on residential premises) Under Council’s DCP 2006 (Part B - Exempt and Complying Development), air conditioning units for dwellings are permitted as exempt development, meaning they do not require development consent where they are located a minimum distance of 3 metres from any property boundary and located behind the building line to any street frontage. Purchasers of domestic air conditioners should consult Council’s DCP 2006 to ensure compliance with these requirements. Where there is non-compliance with this DCP, a development application shall be required. Re: Who else is building with Eden Brae? 13531Apr 10, 2016 7:48 pm Hasan_S14 kbhouse Thank you for the info about the OC. Relieved to know that we can get the interim OC in the meantime. Is it easy to render after the hand over? Any potential issues like certain bricks not being suitable for rendering? Hi Kbhouse We have done our render during the building time. Our site supervisor is very helpful and he recommend his friend who used to work for EBH. And he allowed his friend to do the renden before handover. Let me know if you need the render person's details. Here is the picture of our house. Like ⋅ Add a comment ⋅ Pin to Ideaboard ⋅ Thanks Hasan_S14! Wow, would love to have your SS as ours! Re: Who else is building with Eden Brae? 13532Apr 12, 2016 5:09 pm Is rendering mandatory? I remember Eden Brae charging an arm for this. I've got some cladding and timber poles at the moment which I plan to replace with bricks once the 5K is deposited in my account Handover is next month so I hope to get this sorted before it comes as a shock. Rendering is not mandatory. Having a different material (other than brick) on the facade is a developer requirement usually if you are building in a new estate.
