If you are on the high side, why would you need a retaining wall? Especially if your neighbour's block has been cut by their builder? Did EB form up your block above natural ground level? We sit on the low side, EB cut into our block, but neighbours builder formed up their block by 600mm above natural ground level, hence why we are sharing the cost of the wall. If they didn't form up, then the wall would be our responsibility, as EB lowered our block when they cut to build our house. This is the thing, i say 'we need a retaining wall' - by that i mean 'a retaining wall will need to go in' it might only be a small one, but im just unsure how responsibilities for retaining walls are handled. Depending on what i read it can come across: - that i need to put it in to prevent my block from falling down into the neighbors block - that whoever is on the lower side needs to deal with it Finding credible guidance is challenging, the neighbors may have it in as part of their build i don't know, haven't chatted to them about it yet, i thought originally it was just a 50/50 split like with the fence, but this doesn't seem to be the case. I think you will find under the Fencing Act NSW that if a retaining wall/system is required to maintain the structural integrity of a boundary fence, it becomes part of the fence and the cost is shared by the owners either side of the boundary. We dont have one so dont know the charges or how they calculate the costs, but id like to find out for other reasons.
