Make it clear they aren't getting any more money until the job is complete. Sometimes being nice doesn't pay off and you've got to be an a**ehole so they stop taking advantage of you. Yeah, you are right, but difficult when no one returns calls, we then complain to HO receptionist and eventually If we are lucky we have some contact. Thanks Transformation, I really hope so. We've been in the house for over 7 months now and all resort pools had to do is finish off the pool as the concrete shell was already done. Our house builder managed to build a two storey 40sq house in 7 months yet the pool builder cannot get their act together and finish the pool. Re: Building the Majestic 40 - pool saga goes on :( 647Nov 05, 2013 5:22 pm We'll take one step at a time and refer our pool contract to the contact the Dept of Fair Trading (DFT) have provided us and see what they say. DFT have been very helpful and made a note on their records of the issues we are experiencing with this company. The pool people are also asking for more money, 50% mark up of the retail price for our filter box. We rang the supplier and received the retail cost, which is pretty much the same amount as to what was quoted in the contract. As they want us to pay 50% above the amount this amount, we are asking for evidence to support the extra cost, also confirmed by DFT that they should do if the cost is over the provision amount. However the pool people are silent on this request so far. Also from our reading of the contract we also believe they have not fulfilled a section of the contract and as they are not replying to emails or contacting us at all, it appears we are now at a standstill. Unfortunately the way the contract is structured, we have already paid 95% of progress payments, so whilst not much is owing, there are still quite a few things to be completed. They have not provided the pool cleaner nor instructed us on how to use the filter, so we are trying to keep the pool clean as best we can but it is getting more dirt in it which is difficult to remove if you don't have the pool cleaner nor a functioning filter. So now we can't really use the pool anymore I remember your drama's Gogo, but at least it did get finished eventually, so hopefully ours will sometime soon too. It is very disheartening to spend so much money on a pool and not be able to use it, it is upsetting and stressful going thru these drama's I can't think about the pool at all now and don't even want to go outside as I don't want to look at it. (or contact the manufacture) We did get a pool cleaner with our pool, but don't use it as we have found it doesn't clean very well at all, so DH just vacuums every two weeks. Stick to your guns about the pool filter box, DH built ours, which was good, as they are bl00dy expensive for what they are. Sending positive thoughts!!! I would go with what Gogo said and get a pool company out. We used to use Dural Pool Smart and Swimart at Dural. If you call up one of them you will be able to get them to come out. Dural Pool Smart is very knowledgeable Hopefully Dept of Fair Trading will sort everything out for you. They will only give the pool company reasonable time to fix the pool and then they will fine them and suspend their licence if need be. With the pool cleaner, I would recommend a Polaris. We got out through Pool Shop who are on the Northern Beaches. They were quite a few hundred dollars cheaper than the rest and we never had to manually vacuum the pool. Dural is around an hour from our place, so we may have to look for someone closer. DFT advised us to lodge an application with the consumer tribunal as it is a contractural dispute. Collating info now to do this. I've been discussing this issue in the pool forum and heard that someone has a major issue with Resort pools and will be taking legal action. As per usual NO show. We've been told the pool needs to be drained and then another acid wash to be done to clean the lining. So we've not bothered to buy a pool cleaner just yet. Once the pool was drained, they did another acid wash, we could see more of the blue in the lining once that was done. Friday night we started filling the pool with water again, completely full this morning. They are due to come today or tomorrow to complete everything. It is ashame you have to go to fair trading to get some action. I hope you have had some progress today, with the rain and all. If nothing else, the rain has helped you refill the pool. Were you happy with your landscaper? If so, can you pm their details to me, would like to get a quote eventually. We are not near that stage but hopefully will be next year. Re: Building the Majestic 40 - now another pool problem :( : 660Nov 18, 2013 6:01 pm Well they did come back today and at lunch time the pool was a lovely blue colour as it should be. Handover scheduled for Friday, they will finish off a couple of things then too. So pleased they have come to finish it and didn't have to go to the consumer complaints tribunal However, I beginning to believe this pool is jinxed............... about an hour ago we just had a huge downfall of rain. On the weekend the neighbour got top soil for their backyard but didn't order enough turf to cover all of the soil......so with the downfall the rain, dirt has come pouring in from next doors yard into our side and into the pool...... Yep, the pool is now full of dirty brown water. Oh my GOD, I feel sick!!!!! DH getting advice now from the landscaper as to how to stop water coming in, before we talk to our neighbours. They are nice people, so it will be interesting to see how we sort this out. Urgent message sent to the pool people to ask how we sort it out with the pool. Filter on but I guessing it will take a while to clear the water. Hoping the lining has hardened so that the dirt won't get into the lining.
