The fencing people should put fences on the title boundary, but sometimes this may not be the case (laziness????, close enough is good enough ???). When replacing a fence, the new fence may be put 'near' the old location and overtime if this may mean it is no longer on the title boundary. However, as our case has shown as per the following post - http://ournolan.wordpress.com/2012/01/2 ... -of-whack/ the fence is not on the title boundary. This doesn't matter too much for the back fence as we are not building near there. But for the side fences this could be quite important as the house could be incorrectly put on the wrong side of the title boundary. If this was found to be the case after the house has been built, the neighbour has the right to have the part of your property that is on their title removed.
