I have already discussed this on the PD thread, but thought I would post on here to see if any non PD builders have any advice/tips.
To cut to the chase - there was a discount given in our building contract that we signed 2 months ago. The builder has realized today that this was a mistake and we should not have been given this discount as the developer was the one to give it to us, not the builder.
I had a call from the manager today saying they will want a variation signed to re-charge us for this mistake. Of course since we have already applied for finance, this variation would have to come out of our own pocket. This is what we are most upset about. If it were picked up early, we probably would have signed without a second thought.
Anyway, can we fight this and refuse to sign/pay?
The only thing I can see in the contract that seems to refer to mistakes is;
”The Builder is not entitled to claim for extra costs for errors in Plans and/or Specifications that the Builder has prepared”
What do you think?
