Sigh. hi, looks like same boat as me. What r u planning on doing? Trying to be as patient as I can be considering. Spoken to fair trading who advise me to get as much done with the insurer as I can. Waiting on forms the insurance company said would be emailed to me today to fill out. Liquidators say the same thing as fair trading. We were about to start peg out with cosmopolitan constructions. It took 16 months to get our knockdown rebuild DA's due to a very difficult council, cosmopolitan was great through the whole procedure. I cannot speak highly enough of my customer service rep J.T. I hope she is ok. So sad they have gone under. Now devestated. We have paid the 5% deposit, which QBE says we should get back minus their $500 excess fee. I mentioned that another builder will charge heaps more to build our house but QBE said they do not cover the difference. I cannot get through to Worrell's Solvency and Forensics, does anyone have information from them as to what the best course of action is. Will anyone take over to build our houses? If so will the house be built for the same quoted price as we at our limits. Does anyone know how or if we can get a release of contract and a release of copyright of the plans?. How the heck do I know what to claim without inspecting my property which is in lock-up??? we are 1 week from handover! The Liquidator informed me on Saturday to ' secure the site from theft' so I have changed the locks to have some sort of security & access to our house. So I also found this other form called "loss notification form" which doesnt require as much detail. I am waiting to speak to someone at QBE or for update on their website before sending anythin in. I had signed contract and paid the 5% depoist and they went under 1 month before start. Speaking from experience, get you claim forms in ASAP. I had my full refund back within 5 weeks (to respond to earlier post - I did not pay a dime excess). I would get the excess explained as QBE just take your claim and sends to VMIA (or state equiv) to process. To cut a long story short, I had my money back within 5 weeks while the liquidation dragged on for another 4-5 months. [/quote] I would need a building inspector to check the property and confirm what needs to done and what defectts need to be fixed. I just dont know how I get insider the property. Our HWI is with QBE, so we lodged our claim a month ago. Just letting everyone know that if you are insured with QBE, go to their website & you'll find ALOT of information. We found it very beneficial in the early stages. Also, go to the DoFT website, & there you should find info regarding upcoming meetings etc, once again, this site is helpful. If you are affected by this collapse, I just want to say to hang in there & make sure you lodge your claim with your insurance co asap. Regarding access, each to their own however I organised a locksmith to change the locks for me, cost $150 for a rush job on Sunday morning! But now I at least have access to my own house when I need to. I have also started to get two Builders to quote to finish the job off and to include rectification of any defects. Good tip from one of the Builders helping me – chase up your PCA and the Liquidator for any certificates they may have e.g. Plumbing, gas & electrical these are critical for your occupation certificate. No we haven’t paid the final payment and will hold on to this tightly until fully resolved. We too are in the same position - fix up of kitchen bench and then install of stove, hot water and finally the big cleanup! Its just so close..... There may be a risk in changing the locks however I was told by the Liquidator 'to secure the premises from theft'. If you are concerned please seek advice from a good property lawyer - these costs can be included in your insurance claim, I am merely a humble “Bush Lawyer” My attitude (perhaps a little gung-ho) is the quicker you get into your property the quicker this can get resolved. I went to the liquidator's office this morning to ask questions. Think they were a bit put off with a heavily pregnant woman on their doorstep at opening time so they didn't say too much then. I guess my tears didn't help (so cranky I couldn't hold it together). Had a few calls with QBE and spoke to a solicitor. Our biggest concern is whether us moving in and potentially organising appliances to be installed invalidates our insurance policy. So I guess we are having a late night tonight filling out the claim form. Hubby was on site today and caught up with one of the neighbours who was very close to moving in too. And that an information pack would be sent out in the next few days. We've paid our final payment. Payment went through on Thursday. Might've paid for their last holiday. PCA = private certifying authority, this person will issue the occupation certificate that allows you to legally occupy the house. If I can get access, I will organize an inspection and get everything done myself. Although they had this wiz bang chromogen gas and solar thing, so I dont know how hard it is get someone else to do this. On another note, 2 wks Cosmo sent me a variation for connecting sewer outside property line ($6k...) I signed and agreed as I was so close and couldnt be bothered fussing. Even though I thought $6k WTF!! Now I'm thinking could this have been made up on their part?? what do you guys think? I would never build with Fowler homes.
