Browse Forums Building A New House 1 Nov 04, 2011 10:29 am Hi, I recently recieved a letter from the council stating that there is a lot of debri and other rubbish on my block which needs to be cleared by me. They actually sent photos of the debri on my block and also mentioned that if I don't clear them by the given deadline, I would be fined $1000. I actually went over the weekend to have a look at my block and most of the stuff that's in there has actually been dumped by the neighbouring builders. The house next door is almost in the finishing stages so we noticed that the builders have actually dumped things like carpets, concrete, mud and other construction related items. Since we are going to be constructing with the same builders, we actually requested them to clear the stuff they have put on our block. But they were not co operative and said they could only remove those things that belonged to them. They denied that the carpets and other things on my block did not belong to them and could have been dumped by some other builder. As all the neighbouring houses are already finished, there is no else who is constructing apart from me neighbour on the right side. I called up the council over this but they said it was my responsibility to keep the block clean. Any advice on what I can do? The deadline is approaching soon and I'm worried that the council might send me a fine. Please help! Re: Illegal dumping by neighbours builders on my block 2Nov 04, 2011 11:20 am I would speak to the builder and also look at the debris to see if it can actually be tied to the next door build. I would inform the builder that you are going to involve the police because it is illegal dumping. There is just not respect. Re: Illegal dumping by neighbours builders on my block 3Nov 04, 2011 11:46 am Thanks. Yes, I think I would have take some legal steps. I spoke to the council and they have advised me to email them along with photos/any evidence that proves that it belongs to the builder. But, how we can I specifically prove that it belongs to those builders? There is no logo/ sign/ anything that shows that the debri belongs to the builders. Re: Illegal dumping by neighbours builders on my block 4Nov 04, 2011 11:59 am In Victoria, there's the Building Practitioner Board Inquiries where you could exercise your rights to complain about a Registered Building Practitioner who may have breached professional standards. The council should also know who the builder is. I think if you report it to the police they should be able to get the details. what a pita Re: Illegal dumping by neighbours builders on my block 6Nov 04, 2011 12:47 pm Thanks all for your suggestions. I got a call from the neighbour's builder and they said they have only removed the debri that belonged to them (which was basically a temporary fence). They said that the rest of the stuff on my block belongs to other builders and they have evidence to prove that i.e. photos. So I asked them to send me those photos and they just did. Now!! the photos show that the carpet actually belongs to another builder and the mud/concrete dumped in there is some other builder from across the block. phew!!! My land has become a rubbish site for all the builders!! Can't believe it. On top of it council are not at all helping. THey say it's my responsibility while the stuff in there is not even dumped by me. I am going to send an email to council with all the info I have and hopefully they get back with something positive. The frustrating part is they have given me a deadline to clean the block and are not even to give an extension inspite of me explaining the situation to them. Re: Illegal dumping by neighbours builders on my block 7Nov 04, 2011 1:49 pm Wow, that was very nice of your neighbour's builder! With evidence I'm sure you'll get it sorted out. Council is right - it's your responsibility. They don't have the resources to go chasing these things up. So you need to contact the builders who are responsible and get them to remove it before the deadline. If the builders can't make the deadline but can give you another deadline in writing then I would take that to the council and ask if they will accept that. With the bonus that it shows that builder admitting to ownership.
