Our builder has advised us that there is a discrepancy of 1m of fall between the engineering plans and the actual site survey. Engineering plans say 2.5 metre fall and the site survey is 3.5 metre fall. Our site costs have been estimated at $60K Our conveyancer sent a letter to them advising of the problem and the developers basically said "too bad", that the engineering plans are only a guide. This will cost us an extra $35K in fill and retaining walls. Do we have any recourse? Should I stop settlement? Re: HELP!! I'm sure you could pull out, but you would lose your full deposit, so you would have to decide if you are prepared to do that. I think unless you have a clause in the contract stating something along the lines of discrepency then your stuck.
