Browse Forums Building A New House 1 Oct 09, 2011 11:36 am Hi I am wondering if anyone can give me an idea of the time it would take for land to be registered, once all the road, curbing and guttering is in for the stage????? The developer has indicated land will be registered in late november, but I estimate there will be another 3 weeks before all the roads, curbing and guttering (and services) go in......If the program is delayed, I will be hit with a $10k price increase from my builder.....................Although we have not signed the contract with them yet (we have only paid the tender deposit at this stage). In NSW after everything was completed for our land, it had to get final approval from council before approval from the bank and then it the lands department for regsistartion. Our land was approved by council on July 28th and finally registered Sep 27th. Our took longer than expected but our solicitor said the average time in the lands department was 3-4 weeks. Not sure if that helps. PS Our contract had nothing except if it wasn't registered within 12 months then we could pull out. Re: How long will it take for land registration??? 4Oct 09, 2011 5:14 pm I'd recommend preparing to pay that extra $10k and hoping that it all goes through quickly - 4 weeks for approval by the council surveyor/town planner (which can't even begin until -all- works are completed) and the land titles office to actually put together the titles themselves and sign off on them leaves -no- margin for error. It may also possible take 14 days (sometimes more) for settlement - we had a 14 day settlement but I've read anecdotal evidence from others on H1 that their settlements have taken longer. Another option is to go back to the builder and negotiate on the price increase - these price hikes were the norm when the building market was strong but now it's anything but and builders are "slashing" house prices left, right and centre to entice customers, so if they really want your business they'll negotiate on the price increase. Some people apparently have nothing better to do than comment on other people's sigs. If you're organised then once it's titled you can arrange settlement the next day. Council will only look at D.A applications once the land is actually yours. We wanted to settle day after registration but have been unable to due to the vendor having to partition the land (divide up between partners) If we give them a notice to settle it gives them the opportunity to pull out of contract, so we dont want to do that. We can lodge our plans into council once the land is registered if we have an approval letter from the existing owners, as long as our land is pending settlement. Looks like the programme will be too tight - I have asked the builder if they can fix the contract sum until Feb, 2012. I am also obtaining a quotation from another builder in the mean time for a similar house design, as a fall back and check price. Fingers crossed, they will be willing to fix the price until Feb, 2012. If they register the land expecting a settlement in late december and you are unable to settle in time, they will ask YOU to pay the land tax. And it will be written into your contract that you are liable for all costs that accrue after registration but before settlement. So make sure your solicitor/conveyancer and bank know the importance of settling on time if you get a christmas settlement date. We were lucky enough to have a solicitor who pushed settlement through on time, but someone else on this forum wasn't.
