The date for the titles has now been pushed back twice and will be now ready in November (If they arent pushed back again). I was just wondering having signed a contract, if there was any way of getting out oof the contract without penalty. Has anyone been in the same situation? Our contract gave us an out after 12 months. But I do know that another user, Srichz, successfully changed her block of land soon after signing contract - alothough it was through the same developers and in the same area just to a bigger block.... Re: Delayed Land Title 4Sep 12, 2011 8:10 am after waiting for 6 months for the land to tittle ,we were delayed a further 6 months and there was nothing we could do and it sucks! we finally settled 2 weeks ago but all that extra money we have payed in rent was been more cost. If we had known we would have been delayed we wouldnt have purchased the land and have brought an existing house and would have been well into it a year ago. We had timed it right so we would have came off our rent lease straight into a freshly built home ...now im going to have to go and negotiate a 6 month lease with my landlord when i get a start and finish date from my builder to put it short ...you can never trust a developer! We had timed it so that my eldest would be starting secondary school in 2012 by handover. At this point we should get a site start by then! I know it's very frustrating, but stay focused on the big picture, living in your beautiful new home. Best of luck. Re: Delayed Land Title 7Sep 12, 2011 3:31 pm We signed up for our block October 2010, titles due January. Then march. Then June. Then we stopped hearing. We got our titles under 2 weeks ago, found out from our builder before our settlement agent and still haven't heard from the developer! We considered trying to go for a different block, but our builder said we would be better off waiting as if we changed, we would need to start all our negotiations with them all over again. Our mortgage broker also said to stick with it as we save money whilst we dont have land. One thing that we could do to get out of the contract would be to suddenly not have finance, as our contract was subject to finance. I guess it all depends on the finance. We are worried now about having all our stuff ready for settlement date next week. we have had to wait so long, renew loan approval every 90 days then gave up on resigning, then bang settlement due, get your finances in order or you will be penalised. THAT seems unfair! Settlement agent then told me today that owner of land had to sign first as he was going overseas, so that has held up sending us documentation...but as he has signed on time, it will still be our fault if not ready next week. Again UNFAIR!!! My lesson learnt from this: ALWAYS buy titled land! Unfortunately (as others have said) it often isn't worth the hassle (in terms of increased property prices, further delays & more paperwork for bank & builder) to find a different block which may again suffer the same problems!
