The only positive is, you can buy post and rail fence and put the post and rail (ugly side) facing the vacant block. There is no way to legally enforce a future occupant to pay 1/2 of the fencing. That would be like you tresspassing on someones property, installing a clothesline and demanding payment. Weird example. But basically you can't legally force someone to pay for something they had no say in. Fingers crossed you go home tonight and see a sold sign on the block next door. Re: Anyone having problems with fencing-No neighbours/VACANT 3Aug 29, 2011 7:28 pm Best to check the laws for your particular state - in WA, the Dividing Fences Act 1961 covers this, and you can give notice to put up any fence you like, have it approved in court, and if you follow the approval the future owner is liable to pay half of it, even if they had no say in it and didn't own the lot at the time. Unfortunately you do have to arrange the court approval first if you want to go that way.
