As part of the land deal, we were to receive fencing and landscaping from the developer. Since last November 2010 I have been trying to contact the person in charge at that company without any luck. I have rung the office twice and the receptionist has said he will call me upon his return but he never does. I have also emailed 3 or 4 times and the last time I even requested a 'read receipt' so I could be sure that it had been received and read. When I called the company who sold us the block to find out what could be done they told me that other people who bought land there were also having problems getting in touch with this man. Has anyone else had this problem and if so what did they do about it? Re: Fencing and Landscaping Package Issues 2Aug 04, 2011 4:00 pm I am in no way qualified to give legal advice, but I would suggest writing a letter outlining the issues - you paid $x amount for land on x date, with a contract stating fencing and landscaping was to be included. You have tried phoning on x, x, x date, sent emails on x, x, x date and have not yet received a reply. Request a written reply within 14 days advising what their intentions are to rectify the fencing and landscaping issues, or further action will be taken. Send it via registered post so you can be sure it's been delivered. Keep a copy of the letter too. Keep copies of everything - records of phone calls, emails, etc. You can go to your local court house and lodge forms to take them to court. It costs us about $75 to do this. You will need to know the $$ figure you wish to claim. So if your contract states an amount you would use that, otherwise if it says $x amount for landscaping + fencing to the property, then get a quote for the fences and add that to the landscaping amount. If it just says fencing and landscaping, then you would need to get a landscaping quote as well. Need more photos from around the house including your gutters.
