Our tiles are actually ceramic and were selected prior to the contract being drawn up. Our tiles are classed as grade 5 so they are the same level of difficulty to lay. Given that the contract specifically states porcelin would we have to pay this provisional cost. The builder has not taken any reasonable steps to find out what they are made of and assumed they are porcelin. It would have only taken a phone call. Any comments. Having laid porcelain and ceramic I didn't really notice any more difficulty on either of them. Ring a tiler and ask what they would charge ? then you could determine if you are being ripped off. You are legally allowed to request to see invoices for all work listed in the provisional cost area of a contract. What I would be doing though is asking "What is the Standard rate per m2 they allow for in their contract" I would expect is is around $60 - $70 m2 but get it in writing Then if (and only if) the Tiler charges more per m2 due to being a more difficult job then you pay that difference. Builder could not produce invoices so legally they had to re-imburse me the money. All items listed in provisional costs have to be accounted for before they can charge you (Not that builders actually do that unless you ask) As per your post you could argue a technicality whether it is Porcelain or ceramic or whatever but, but personally I don't think that is in the spirit of the agreement you entered into, and I would expect if it went to hearing the real focus would be "Did it cost more to lay the tiles?"
