We finished building our house April 2010 and are now in the process of putting a shed in the back corner of our yard, on the boundry. We have been given council approval (Marion) but our neighbour is not giving us consent to take down the fence. Does anyone know what we can do or where we stand on this issue. We want to maintain a reasonable relationship with our neighbour but on the other hand what to get the shed we want and where we want it. Any suggestions or advice will be great. Have you discussed with the neighbour what their objection is? I know my wife would veto it right away on aesthetic grounds. There is a difference. In the second case the fence remains and the shed is within the normal 900mm or 1200mm requirement for structures to be away from property boundaries... It means you can put it up to the boundary or in other words close to. I have never heard any one put up a non masonry wall that forms the fence. If you want it like this you will need to build the party wall in a masonry product.
