Browse Forums Building A New House 1 May 27, 2016 5:44 pm Hi guys, I’m building a new house in Melbourne with a volume builder, they’re very famous and I don’t want to mention their name at this stage. The house will be handed over very soon. But one thing is bothering me is my builder left a big concrete block at my backyard which they dug out from underground in Oct last year. When I demolished the house and handed over the land to my builder, it was clear and clean. They dug it from underneath in the excavation and just put at back of the house. Now the side access is only 1.8 meters and it’s not easy to have big bobcat to get in. When they just dug it outside, my builder promised they would remove it soon. Until last week, they still promised me it would be removed before handover. But today they just get back to me it cost too much, they wouldn’t remove it and all concrete blocks from underground should be my responsibility because it’s not rubbish, it’s belonging to me. My question is this really my responsibility to remove the concrete which from underground? It’s a lot easier if they just put in the front of the house at the beginning. But now I have no ideas how to deal with it. Any recommends guys? Please help!!! Check you contract documents. here in wa the siteworks includes site clean, scrape, grade and remove rocks,building material, debris, etc..check your Engineering drawings it should be in the notes under siteworks vvmelb My question is this really my responsibility to remove the concrete which from underground? The note said "It is the responsibility of the owner to undertake removal of any site spoil/stock piles to the satisfaction of the builder prior to commencement of construction or a variation will be incurred of cost." I'm unhappy because he didn't keep his promise and never mention it should be my responsibility until today.
