Browse Forums Building A New House 1 May 16, 2011 10:41 pm Hi, I called Consumer Affairs twice to ask about payment before defects were fixed. The first time I was told I should make progress payment and raise defects repair later. The second time I called I was told I should not make payment until all the defects are fixed. When I talked to my Archicentre inspector he said I have to check my contract (I think it says I need to pay once a stage is completed regardless of defects). However I think the final payment should not be made until all defects are fixed and the house is handed over to me. What do you all think? Re: Payment and defects 3May 17, 2011 9:04 am It may seem like you are paying for ** work during the build when they have cut corners or maybe done half of what should have been done, but if you delay progress because of a delayed payment, they consider it your fault and may hold you responsible for finishing late so progress payment have to be payed regardless. But FINAL payment after inspection should not be paid unless everything in the contract is completed and all problems fixed. You can withhold final payment until fixed because it must be a fully completed home. Don't let them tell you that they will be back to fix during the maintenance period because, chances are, they may make excuses and won't be back. __________________________________________________________________________________________________________________ All new built homes look like display homes... until the furniture goes in.
