I was wondering if anyone could help we out with the following I am in Qld I have a HIA contract when does the building contract start 1. when contract was signed 2.when the finance was approved 3.when building work was approval 4.when they started work 5.when they stated on the contract we have a problem as they stated on contract 9 august they didnot get money from bank until 13 august approval od building work was 5 sep work didnot start on site unti oct Re: A question regarding a building contract 2Jan 09, 2008 11:51 am from my limited knowledge I would say
the contract begins from when you both sign it (subject to finance?) then they are supposed to commence within the time they specified in point 9 on the contract schedule SUBJECT to everything in clause 7 (eg must have finance, deposit, all shire/water approvals etc) thats just my take on the situation, might be wrong! of course some delays happen from time to time Re: A question regarding a building contract 3Jan 10, 2008 10:42 pm Yeh, I think that it is required within 30 days of ACC (Authority to Commence Construction) which is subject to finance approval etc... Your Contract may indicate within 30 days of signing it, but your finance approval and other items can have bearing on this.

If it's subject to finance and finance was not approved, then there's no contract anymore. It really depends on why you are after it. For example if you are trying to work out when your house will (should) be finished, you need to work from the site start date. For Example our contract was signed on October 18th but they didn't start on site til Dec 5 so the build time in our contract is 160 days and this starts from the site start date.
