Browse Forums Building A New House 1 May 06, 2011 9:34 am Hi all, We would like some advice on an issue with our new house; during the heavy rains in Feb this year, rains has started to seep into our house and we have seen mould in between the plaster board and the conices in one of our bedrooms. My builder has refused to replace the entire plaster in the room, and during our latest inspections, mould has reappeared. Our SS mentioned that they will replace only the mould affected area but we are not convinced that will get rid of the mould. From our impression, the builders arent willing to replace and check if the internal insulation was also affected. Please advise what are our rights & what are our recomendations next steps to get this resolved? Thanks Heaps! Hi Cream Persist with them ..... you did not contract them to provide you with a home that leaks and allows mould growth. Mould these days is treated very seriously as it can raise health issues. We have been battling with this company for approximately three years in attempts to have various defects rectified. Persist Persist Persist! They will attempt to fob you off in the hope that you will walk away. Mould in plaster is not "fit for the purpose" ( refer Statutory Warranty Clause 11.2 of your contract ). Likewise, mould in plaster would not comply with building regulations etc ( refer Statutory Warranty Clause 11.3 of your contract ). Keep at it Cream......very labourious and extremely time consuming but you must, to get the home which you contracted them to provide. Good luck with it all ....... keep us updated with the outcome.
