I just don't know what to think anymore Re: NBG Buckingham 46 in rural vic - tiling has started 424Oct 17, 2012 12:25 pm I think you nailed. it. they did tell me they were contemplating it, but they were actually trying to work out a way around it, ie by trying to pass over some of the jobs to other builders, get people like us to finish the jobs ourselves etc. I think the ones they finish will be done on a budget to get whatever cash they can to see if they can stay in business. I was surprised when someone told me they were planning to file next week, as this was not the impression I got and they would not be doing work if that was the case. I am not sure we would get an honest answer out of these guys. At the end of the day the waiting is costing us, so we want to get more of the build under our control, which we are doing, without letting manbuilt off the hook. Cause I do t think I can handle it anymore and to be honest I am at breaking point witht the whole thing I break down in tears every time I look at the house cause I know I'm paying a morgage for something that I can't live in. I don't think it's fair that I am bring my boys up in a shed when our house is there and a useless builder just won't finish it or give us straight answers as to what is going on. Trying to work things out with the builders but they won't respond to my requests for information or put exactly what their offer is in writing. There is not a lot left to do with my house and if they do file then building insurance may not cover the penatlies for the delays in going over the contract. In the meantime the penalties for delays are increasing each week which is most likely going to be useless since building insurance probably won't cover. I am well and truly stuck until something happens........ If you go down the path we are just be careful to document what work they already did vs what part you finished, as when you take over the job you take over the liability for the completion of the work and any issues associated with it. Ie I have arranged the painting, and any issues with the painting is between me and the painter, manbuilt will have no responsibilty for it. Which I think to be honest we would be anyway if we had to get it fixed after liquidation as no builder would take us on where we are. Its hard to work out how to get out from between that rock and the hard place. We cleaned our place ourselves. My mother and father in law came for a visit and helped us all day sunday, it took four of us a day, to clean up all the rubbish, vacuum etc so they could paint the place without painting dust onto the walls. We already have a rubbish service for the farm with Bells bin hire so we are going to get them to send us a skip to take away the stuff we cannot just burn. Enough was enough for us after now close to 2 years of building with them and having run over the build time of 15 months we called it quits. They have issued us for fix and works incomplete and that avenue was exhausted by going consumer affairs. Phone call from builder other day stating plumber been ready for a couple of weeks to do septic and water tank, spoke with council next day and they alledge that permit for septic expired beginning of october. So the situation could have dragged for more months so who whos how much more over the build time we would have gone on for. I suppose we are more fortunate than you as we hadnt paid them any more money. We had 2 independent inspectors through the house and there is so much to rectify, so now 3 builders into quote to finish the works and quote separate on damages. I suppose litigation will follow. We are essentially finishing the place ourselves, just getting variations from manbuilt to do it. We are pretty over them. It will cost us slightly more than we owe to get it finished, but we won't let them off the hook for now so we can claim the rest via insurance, if not we will just write it off, we could sue them for penalties etc but if they don't have any money what's the point. Colerain no need to apologise, can't imagine how stressful it is for you and equine to be living in a shed with your family and not knowing when your homes will be finished. Tash Re: NBG Buckingham 46 in rural vic - tiling has started 436Oct 23, 2012 10:11 pm Sorry to hear that you are having so many heartaches with your homes, I came across this post researching Manbuilt, I have supplied bins for them to a few different sites (Kyneton and Flowerdale for example), and know they have outstanding invoices, so I visited the address in Epping and found out its been empty for nearly 2 months, so if someone has another address I could chase up it would be much appreiciated. I am sure that most people on this post would also like to keep track of where they have moved to. I hope that you all get to move out of your sheds into your finished homes soon.
