Browse Forums Building A New House 1 Apr 13, 2011 3:50 pm So it sounds like a stupid question but when should a builder actually do the 3 month maintenance of a new home that they are obliged to do under the contract? I moved into my home in mid-December of last year. There were still a few items to be remedied but the builder refused to pay me any more liquidated damages (as an Occupancy Permit had been issued) so I had no choice but to take possession. Those items have never been fixed and there are a few (largely minor) other problems which have also shown up over the past 3 months. I sent off my 3 month maintenance checklist (in writing) in early March. Then received a letter which basically said "we're really busy, we'll get to you when we can". I've heard absolutely nothing since. Noone has even come out to my home to look at the issues I have raised nor have they given me any estimates of how long it may take. Is there anything I can do to force the issue? If so who would I go to? I just think it's immoral for them to continue advertising (which they do allllllll of the time on TV and radio) and taking on new work when they haven't even finished my home properly Thanks in advance Re: 3 month maintenance; when should it be done? 2Apr 13, 2011 4:34 pm Like you, I moved in mid-December. There are still things to be completed, so the builder and I have agreed that the defects list can come 3 months aftert things are completed. To answer your question, the contract will state how soon after the defect list is submitted that everything has to be completed. In my case, using the NSW Department of Fair Trading contract, it states "The contractor must rectify the omissions and defects at the contractor’s own cost within 30 business days from receipt of such notification and the owner must give the contractor reasonable access for this purpose." I'm sure the HIA contract has something similar. I had handover in Nov last year and gave them my 3 month maintenance list in February 2011. I have had about half of the items fixed but the harder jobs have just been left. I have even been chasing the tradesman who are supposed to be fixing the items myself (without a great deal of success). I have looked over my hia contract but couldn't find and exact time frame - it states within reasonable time. Im wondering what i can do to get it sorted - im just sick of looking at the unfinished work.
